End User Acceptable Use Policy

This Acceptable Use Policy (this “Policy”) describes prohibited uses of the services (the “Services”) offered by CSC Partners, LLC and its affiliates (collectively, “TalkBackTime,” “we,” “us,” “our”) and our website (the “Website”). The examples described in this Policy are not exhaustive. We may modify this Policy at any time by posting a revised version on the Website.

  1. 1. Responsibility for Acceptable Use.

    By using the Services or accessing the Website, you and any users you permit or authorize to access the Services on your behalf (collectively, “you,” “your”) agree to the latest version of this Policy. If you violate this Policy or authorize, permit, or assist others in doing so, we may suspend or terminate your use of the Services.

  2. 2. Compliance.

    You must use the Services in compliance with this Policy, applicable law, and any End User License Agreements (“EULA”) and other agreements that apply to the Services.

    You must also use the Services in compliance with any privacy policy or other description of your privacy practices you publish or make available with respect to the Services.

  3. 3. No Illegal, Harmful, Fraudulent, Infringing, or Offensive Use or Conten.t

    You may not use, or encourage, promote, facilitate or instruct others to use, the Services or Website for any illegal, harmful, fraudulent, infringing or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, fraudulent, infringing or offensive. You are prohibited from engaging in any activity or providing, submitting, or disseminating content that is illegal; violates the rights of others; may be harmful to others, our operations or reputation; or may be deceptive or fraudulent, including without limitation and by way of example:

    • Disseminating, promoting, facilitating, depicting, linking to, or glorifying child pornography, non-consensual sex acts, or bestiality;
    • Activities or content that are harassing, obscene, abusive, bullying, defamatory, discriminatory, or otherwise objectionable;
    • Promoting or inciting hate speech or violence (including without limitation speech attacking or advocating for the exclusion or abuse of people based on ethnicity, national origin, political or religious affiliations, gender, sexual orientation, genetic predisposition, disability, medical or physical condition, veteran status, or any other protected classes under applicable law);
    • Infringing or misappropriating the intellectual property or proprietary rights of others (you must have the appropriate rights to any content provided, posted, or collected through the Services);
    • Disseminating, promoting, facilitating, depicting, or linking to content, information, or techniques that damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including without limitation the posting or distribution of any “harmful” or “malicious” code or programming devices (e.g., viruses, malware, ransomware, corrupted files, key locks, back doors, trap doors, timers or other disabling devices) or any other similar software or programs that may adversely affect the operation of the Services or any other software, hardware, computer, communications system, network, computing device, or other technology (each a “System,” collectively “Systems”), or any links thereto (collectively, “Malicious Code”);
    • Phishing or pharming;
    • Offering or disseminating counterfeit or fraudulent goods, services, schemes, promotions, make-money-fast schemes, Ponzi schemes, or pyramid schemes;
    • “Framing” or using the Services or any content in any way that might confuse, misdirect, or misrepresent their source, or sponsorship or affiliation thereof or therewith;
    • Misrepresenting how you use the Services or information collected through the Services, such as by representing that survey responses are confidential and/or anonymous when they are not;
    • Artificially inflating or manipulating search engine rankings or website traffic;
    • Impersonating another person or entity in using the Services, communicating with third parties, or collecting information;
    • Collecting (or attempting to collect) social security numbers, credit card or financial account numbers (other than solely for purposes of collecting payment through an authorized payment processor as, and to the extent permitted by, the Services), or passwords or other similarly sensitive information;
    • Collecting (or attempting to collect) information from minors;
    • Collecting or processing “protected health information,” as defined by the Health Information Portability and Accountability Act of 1996 (HIPAA) and its regulations, “nonpublic personal information” as defined by the Financial Services Modernization Act of 1999 and it’s implementing regulations, “cardholder data” or “sensitive authentication data” as defined by the Payment Card Industry Data Security Standard, or information protected by similar laws or obligations (collectively, “Restricted Information”) without obtaining prior written authorization from us;
    • Processing, use, or disclosure of personal information in violation of law or applicable privacy policies and practices;
    • Publishing of personal information against an individual’s wishes; and
    • Violating individuals’ privacy or privacy rights.
  4. 4. No Security Violations

    You may not use the Services to violate or attempt to violate the security or integrity of any System. Prohibited activities include, without limitation and by way of example:

    • Unauthorized Access. Accessing or using (or attempting to access or use) any System without permission, including:
      • Bypassing (or attempting to bypass) any security or authentication measures used by a System; and
      • Circumventing (or attempting to circumvent) limitations we impose on your account (including without limitation opening a new account to create or distribute a survey, form, questionnaire, or content we have closed or suspended for policy or terms violations).
    • Monitoring of data or traffic on a System without permission.
    • Falsification of Origin. Forging TCP/IP packet headers, e-mail headers, or any part of a message describing its origin or route. The legitimate use of aliases and anonymous remailers is not prohibited by this provision.
  5. 5. No Network Abuse.

    You may not make network connections to any users, hosts, or Systems unless you have permission to communicate with them. Prohibited activities include, without limitation and by way of example:

    • Scraping, Monitoring or Crawling. Using any robot, spider or other automatic device, manual process or application or data mining or extraction tool to:
      • Access, monitor, copy or use the Services or any content;
      • Register accounts;
      • Create or provide content; and/or
      • Monitor or “crawl” a System in a manner that impairs or disrupts the System being monitored or crawled.
    • Denial of Service (DoS). Inundating a target with communications requests so the target either cannot respond to legitimate traffic or responds so slowly that it becomes ineffective.
    • Intentional Interference. Interfering with the proper functioning of any System, including without limitation any deliberate attempt to overload a system by mail bombing, news bombing, broadcast attacks, or flooding techniques, by working to block or prevent authorized access to the Services or any System, or taking any action that imposes an unreasonable or disproportionately large load on the Services or any System.
    • Operation of Certain Network Services. Operating network services like open proxies, open mail relays, or open recursive domain name servers.
    • Avoiding System Restrictions. Using manual or electronic means to avoid any use limitations placed on a System, such as access, account, and storage restrictions.
    • Penetration testing. Unless authorized by us in writing in advance, you may not probe, scan, or test the vulnerability or security of the Services or any of our Systems or networks.
  6. 6. No E-Mail or Other Message Abuse.

    You will not distribute, publish, send, or facilitate the sending of unsolicited mass e-mail or other messages, promotions, advertising, or solicitations (like “spam”), including commercial advertising and informational announcements, and will comply with all applicable laws and legal requirements in sending e-mail or other messages (including, without limitation, valid opt-out or unsubscribe links).

    You will not alter or obscure mail headers, use deceptive subject lines or false or misleading header information, or assume a sender’s identity without the sender’s explicit permission.

    You will not collect replies to messages sent from another internet service provider if those messages violate this Policy or the acceptable use policy of that provider.

  7. 7. No Competitive Use

    Except to the extent expressly permitted under the EULA, [insert hyperlink] you are prohibited from:

    • Copying, reproducing, modifying, using, republishing, uploading, posting, transmitting, selling, reselling, licensing, renting, leasing, lending, or otherwise distributing or commercially exploiting in any way, the Services or Website;
    • Decompiling, reverse engineering, disassembling, otherwise attempting to derive source code from, or modifying or creating copies of or derivative works based on, the Services or Website; and
    • Purchasing, using, or accessing the Services or Website for a competitive purpose, including without limitation building a competitive service.
  8. 8. Our Monitoring and Enforcement

    We reserve the right, but do not assume the obligation, to investigate any violation of this Policy or misuse of the Services or Website. We may, by way of example and without limitation:

    • Investigate violations of this Policy or misuse of the Services or Website; and/or
    • Remove, disable access to, or modify, or require you to remove, disable access to, or modify, any content, account, or resource that violates this Policy or any other agreement we have with you for use of the Services or the Website.

    We may report any activity that we suspect violates any law or regulation to law enforcement officials, regulators, or other appropriate third parties. Our reporting may include disclosing reasonable customer information. We also may cooperate with law enforcement agencies, regulators, or other third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Policy.

  9. 9. Reporting Violations of this Policy

    If you become aware of any violation of this Policy, you will immediately notify us and provide us with assistance, as requested, to stop or remedy the violation, including removal of users and/or content that is in violation of this Policy.
